Terms & conditions

Terms of business for our website and products. The following terms and conditions apply to all use of this website and to any purchase of goods or services through it. If you proceed with a purchase through the website, or on the basis of information on the website, you will be bound by these terms.

Fitness for purpose

It is expected that the purchaser of a product is familiar with the product and its application. It is the user's responsibility to test a product using the downloads available from this website, or to ask before purchase if there is any doubt about whether a product is applicable. If we are asked, and it is within the field of our experience, we will do our best to advise whether a product is suitable for the intended application. Otherwise the purchase and the application are at the user's own risk.

Because of the nature of PCs and the way they are used, and because software and services from third parties are often installed without the user's knowledge or consent, Neptune products cannot always be guaranteed to perform fully.

The only guarantee of working and performance given by Neptune is that our products will operate on a clean Windows installation on our test PCs, which vary as Windows and the available hardware change. Should a user purchase a licence for a product that turns out to be incompatible with their PC hardware and installed software, we will within a reasonable period consider their situation sympathetically and, at our discretion, offer a refund on proof that the software has been fully removed from the user's PC. That involves Neptune issuing a code that disables the software on the user's PC and then allows uninstallation.

We do not undertake to debug or rectify a user's PC or mobile device in the event of any incompatibility, performance problem or other issue. It is the responsibility of the user to remedy such problems, either themselves or through a third party service. In the course of any discussion about our products we will pass comment on the user's situation. Any comments passed by Neptune are given in good faith only, and if the user acts on them their actions are at their own risk. Neptune is not liable or responsible for the user's PC.

Software licensing

As is common practice with computer software, all rights to the program are retained by the developers, and any purchase of software is the grant of a non exclusive right to install and run the software on a particular machine, by the purchaser, within the specific terms of that licence.

Some software permits installation on more than one PC, but only for exclusive use by the same individual for personal use. Additional machines may require more licences. Licences are not transferable without prior consultation between the original purchaser and Neptune.

Returns

You may return a stock product, even if it has been correctly supplied in accordance with your order, within 7 days. If you have received hardware or media and it is not in a damaged condition it will be replaced without charge.

If you wish to return any product other than as above, you must obtain the prior consent of Neptune Navigation.

Website availability and accuracy

We will use our best endeavours to provide uninterrupted access to this website. It is hosted at a commercial hosting company and occasionally may be subject to problems beyond our control. Inevitably there will be some periods of non availability when maintenance or updates are required. We can give no guarantee of availability at any specific time, but outages should be rare.

We hope to keep all information correct and up to date at all times, but cannot be held liable for any errors. Under no circumstances will we be liable for any costs beyond the refund of the purchase price paid to us.

Disputes

In the event of any dispute you must make your complaint to Neptune Navigation in writing, to the address on the contact page. If it is not possible to resolve the dispute by negotiation, the matter shall be determined under the laws of England and Wales.
